Terms of Service

Terms of Service

Effective date: 2026. These Terms of Service (the “Terms”) are a binding agreement between you and ChequeMate. They also serve as the end-user license agreement for the app and include an Acceptable Use section. Please read them carefully. They include a binding arbitration clause and a class-action waiver that affect your legal rights. They incorporate our Disclaimer and Privacy Policy.

1. Acceptance and eligibility

By accessing or using ChequeMate you agree to these Terms. If you do not agree, do not use the app. You must be at least 18 years old and able to form a binding contract to use ChequeMate. By using it, you represent that you meet these requirements.

2. License and intellectual property

Subject to these Terms, ChequeMate grants you a limited, revocable, non-exclusive, non-transferable license to access and use the app for your own personal, non-commercial financial education. ChequeMate and its licensors retain all right, title, and interest in the app, including its software, models, content, design, and trademarks. No rights are granted except as expressly stated here.

3. Educational service only, not advice

ChequeMate is an educational and informational tool. It is not a registered investment adviser, broker-dealer, financial planner, or tax adviser, and it does not provide personalized investment or tax advice. All outputs are estimates. Please read the Disclaimer, which is part of these Terms and explains these limits in full.

No advisory or fiduciary relationship is created by your use of the app. Nothing in ChequeMate is a recommendation to buy, sell, or hold any security or to open, close, or roll over any account. You are solely responsible for your own financial, tax, employment, housing, relocation, and investment decisions.

4. AI explainer

ChequeMate includes an AI explainer that narrates the numbers shown in your projection. It is an automated system, not a human and not a licensed adviser. Its responses are machine-generated, may be inaccurate or incomplete, and must not be relied on as professional advice. You should independently verify anything important.

5. Your inputs and accuracy

ChequeMate's outputs depend on the data and assumptions you enter. ChequeMate does not verify your inputs and does not guarantee that any output is accurate, complete, current, or error-free. Estimates are not guarantees. You are responsible for the accuracy of the information you provide and represent that you are authorized to submit it.

6. Third-party account linking

You may choose to link a financial account through our third-party provider (SnapTrade). Any such connection is read-only. ChequeMate never moves money, never places trades, and never executes transactions. Your use of third-party services is subject to their terms and privacy policies, and ChequeMate is not responsible for those services or the data they provide.

7. Acceptable use

You agree not to, and not to attempt to:

  • use the app for any unlawful, fraudulent, or infringing purpose;
  • scrape, crawl, harvest, or use automated or bulk methods to access the app or its data;
  • reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying models, except where this restriction is prohibited by law;
  • resell, sublicense, or commercially exploit the app or its outputs;
  • circumvent security, interfere with the service, or introduce malware or excessive load;
  • submit another person's financial-account credentials or personal data without authorization;
  • use ChequeMate or its outputs to give investment or tax advice to third parties or to hold yourself out as an adviser; or
  • abuse, harass, or misuse the app or other users.

We may suspend or terminate access for any violation.

8. Disclaimer of warranties

The app and all projections, scores, scenarios, and tax estimates are provided “as is,” “as available,” and “with all faults,” without warranties of any kind. To the maximum extent permitted by law, ChequeMate disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. ChequeMate does not warrant that outputs are accurate, complete, current, or error-free, or that any tax figure matches your actual liability or any taxing authority's determination.

9. Limitation of liability

To the maximum extent permitted by law, ChequeMate and its affiliates, officers, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost investment gains, lost data, or lost opportunities, arising out of or relating to your use of the app, under any theory of liability, even if a limited remedy fails of its essential purpose. ChequeMate's total aggregate liability will not exceed the greater of the amount you paid to ChequeMate in the twelve months before the claim or one hundred US dollars.

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud, intentional misconduct, or gross negligence. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless ChequeMate and its affiliates from claims, losses, and expenses (including reasonable legal fees) arising out of your misuse of the app, your violation of these Terms, or your violation of any law or the rights of a third party.

11. Binding arbitration and class-action waiver

Please read this section carefully. It affects your legal rights. It requires most disputes to be resolved by binding individual arbitration, not in court, and it waives your right to a jury trial and to participate in a class or representative action.

Except where prohibited by law, you and ChequeMate agree that any dispute arising out of or relating to these Terms or the app will be resolved by binding arbitration on an individual basis, and not in a court of law. You and ChequeMate waive the right to a jury trial and the right to bring or participate in any class, collective, or representative action.

You may opt out of this arbitration and class-action-waiver section by sending written notice within 30 days of first accepting these Terms, using the contact details below. If you opt out, the rest of these Terms still apply. This section does not apply to the extent it is unenforceable under the law that governs you.

12. Governing law

These Terms are governed by the laws of [governing-law jurisdiction placeholder], without regard to its conflict-of-laws rules. Venue and jurisdiction for any matter not subject to arbitration will lie in [venue placeholder]. This placeholder must be completed by counsel.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide notice and, where appropriate, ask you to accept the updated Terms before you continue to use the app. The effective date at the top reflects the current version.

14. Termination

You may stop using ChequeMate at any time. We may suspend or terminate your access at any time, including for a violation of these Terms. On termination, your license ends. Sections that by their nature should survive, including the disclaimers, limitation of liability, indemnification, and dispute resolution, will survive.

15. Contact

Questions about these Terms, or a request to opt out of arbitration, can be sent to the contact address provided in the app. [Contact placeholder to be completed by counsel.]
